Legal rights of tenants in AZ?
I moved into an apartment 3 weeks ago which smelt heavily of cigarette smoke. I tried to get the smell out with fabreeze and an air purifier but nothing worked. (On a side note there is only 1 window in the front of my unit so I can't air it out) Currently, everything I own (including my cat) smells heavily of smoke. Since I am not a smoker, at least to me, I feel like my belongings are now ruined and this is causing much undue stress. My main questions are, should the landlord be responsible for A) hiring a professional to get rid of the smell or B) allow me to move into a new unit? Thanks!
Just as a side note, I did notice the smell during the walkthrough, I even brought one of the managers in there to let her smell it and to complain. Her attitude was "oh well."
Did you notice this smell during your walkthru of the apartment?
If so, you should have said something then.
It won't hurt to ask the landlord to do a steam cleaning of the carpet, but he's not required to if you didn't note it during the walkthru prior to you moving in.
